    Can I Claim on Behalf of My Son
    My son is disabled (9 years old). Today he was physically assualted by a taxi driver who drives him to school. He is currantly being investigated by the police so no names etc.

    Myself and my partner have been concerned about the taxi comany for awhile. Back in september we made a formal complaint about another taxi driver (working for the same company). We advised our local councils department for transport of our concerns as my son had an unexplained bruise which the taxi company refused to aknowledge and the school knew nothing about.

    Today I left work early and took my son home myself. Prior to me arriving home the taxi driver concerned had alrerady been to my house and apologised to my partner (guilty concience).

    The police have advised that they will whatever they can.

    My real question is - does anybody think I have a claim for personel injury / neglect on the part of the department for transport and the taxi company / driver.

    Please before I get any comments if I was awarded money for my son it would benifit him and him alone.

    You haven't told us how this affected your child. You may want to discuss the full facts and injuries with a personal injury lawyer.

    We don't know if the taxi company employs the driver or if the driver is an independent contractor - that can make a big difference as to whether the taxi company could be liable for the driver's conduct. You'll want to discuss that with your lawyer.
