Can I Be Emancipated if My Mother Approves
My question involves emancipation laws for the State of: Texas.

I moved out of my parents house and into my grandparents house while i was 14.
I am now 17 years old and will be 18 in july of 2011.
With my mother's permission i moved into my boyfriends house and have lived here with him and his family for almost 6 months.
I have a job and pay for everything on my own. The only thing my boyfriends family is doing for me is providing a house to live in.
I will be graduating in May of this year and hope to attend college in the fall and am hoping to get finacial aid and grants to help out with college.
If i qualify as an independent then i will get more money to help out with that...or so i am told.
My question is, Can i get emancipated if my mother allow's it?
If she has to sign papers she will.

Please reply with facts and not hear say. I really need to find out answers ASAP.

    Thanks :confused::wallbang:

That "only" is one of the biggest factors why emancipation will be denied. Emancipation means YOU provide for your living arrangements. At the going market rate for your area, not just a token amount. As well as things like the utilities, health insurance, transportation, etc.

Even if mom is willing to sign, unless YOU are earning enough to provide ALL of your own support, including for housing and all that it entails, emancipation won't happen.

I disagree with that to an extent. You must be self-supporting, but that doesn't necessarily mean you can't be getting free or discounted rent - but if you were to try to emancipate while in such an arrangement you should anticipate that you will have to convince the court that if the special arrangement ends you won't end up on the street due to your inability to afford rent at market rates.

It does remain possible that if somebody is giving you a free ride, the court could look at the situation and say "You're not self-supporting - your boyfriend's family is supporting you."

Honestly, that's a critical point which I think we often miss when we're answering emancipation posts.

thank you for ya'lls replys. It helped.

    On another note though...
If my boyfriend and i were to move out of his parents house and be able to pay for everything on our own, would that help with anything? Or does it have to be me doing it all myself?...

The court is unlikely to emancipate you in order for you to move in with your boyfriend.
