Civil demand in Louisiana
I recently got a letter from my eployer for a civil demand notice because i was changing the prices of some items at the store on the register for some of my friends. What I am trying to find out is the civil demand notice going to affect me because they guy said he wasnt sure if it was in effect in my state. I live in louisiana can someone please give me some feed back. He also never said anything about police or court or anything like that so am I going to have to go to court or will this be on my record or anything I am only 18.
Re: Civil demand in Louisiana
A civil demand is separate from the possibility of a criminal prosecution. If a police report was made, you can be prosecuted even if you pay the civil demand.
Louisiana's statutes permit a civil demand: "Any person who unlawfully takes merchandise from a merchant's premises shall be liable to the merchant for the retail value of the merchandise taken, if not recovered in merchantable condition, plus damages of not less than fifty nor more than five hundred dollars."
Re: Civil demand in Louisiana
The store I work at pepboys already made me pay the 500 dollars and I already paid it. Now in the civil demand letter I am or suppose to get do I have to pay even more money. Also there was no police report or anything of that nature. So am I still geting a civil demand letter even though I live in louisiana and if I do, do I have to pay more money even though I paid the 500 dollars to pep boys for stolen mercandise.
Re: Civil demand in Louisiana
I have no way of knowing what the earlier $500 was for. They can only make one civil demand for the statutory amount of $50 - $500 (plus the value of any stolen merchandise they were unable to recover and sell), but they would still have a cause of action for a greater amount if they suffered damages in excess of $500.
Re: Civil demand in Louisiana
The 500 dollars was for excatly what for what you quoted above. From the louisiana civil demand. They gave me 2 papers one said I have to pay 500 dollars either from my paychecks or if I get fired which I did I have to still come up with the 500 dollars. So I went and payed that off today send it into the lost prevention guy for pepboys. Now they gave me a 2nd letter and at the top it reads civil demand notice. Now the LP guy I was with told me he wasnt sure if that applied here in my state and if you say what you quoted above is louisiana civil demand law well then I already took care of the 500 dollars and I should be clear right?

Bump...
Any ideas whats going to happen
Re: Civil demand in Louisiana
Not without knowing if they are trying to recoup actual losses, or have improperly made two civil demands.
Re: Civil demand in Louisiana
Well all I know is that they made me pay the 500 dollars right off the bat for the store. Then they gave me that letter without saying they werent sure if it affects here or something of that nature and we left the back room and I went home and I didnt hear anymore about it. That was it basically so I guess I should wait and see or am I clear?
Re: Civil demand in Louisiana
Okay since my last question was geting pretty confusing let me just ask you 1 more question. That day that I was at work was the day the lp asked me to go to the back of the store with him and talk to him and let him know everything that happen. So I told him the truth and let him know what happen and wrote on a piece of paper what happen also. So when we finished talking he gave me a piece of paper and at the top of it, it says Promissory Note. It says that I promise to pay pepboys the sum of 500 dollars. So I payed that and they also gave me a civil demand notice along with my promissory note. So I am not sure what is going to go on with the civil demand notice but my question is. After we finished talking and I got my papers he said just call the store the next day and ask your boss if your termanited or not. So I called and I was termanited so I couldnt work there anymore. So he never mentioned anything about police or jail or court or charges that would be placed against me. So does this mean that I dont have to worry about going to court or the police coming to arrest me? I am just kinda stressing and freaking out thinking that I will have to go to court or go to jail. Even though he never mentioned anything about police or court or charges against me. So should I be okay or should I still be worrying.
I really appreciate your help and answers that make me alot stressed out knowing whats going on.
