    Federal Detainer on Some Who is Already in Prison
    My question involves criminal law for the state of:

    My husband was in fed prison for 10yrs he did his whole time and was put on probation in texas, when he was out they changed his p.o and he didnt met with him before he got put back in jail on new charges for a different crime, Now he has been served a detainer from california for violation of the conditions and/or supervised release... He does not qualify for a IADA. So what should I do? do I get a criminal lawyer in california because I live Las vegas and he is in TDCJ? and what can happen?

    File for divorce which you should have done long ago. Then he can get a court appointed attorney who can try to straighten out this latest mess he has gotten himself into.

    You also don't explain the situation well enough to give any legal advice. In any case, there is nothing you can do other than just waste your time and money.

    Your husband should get legal representation for the probation and/or parole violation proceedings he is facing in California (and Texas, if he's also facing new charges and/or parole violation and/or probation violation proceedings in that state). You haven't given us enough information to say more than that.

    He has already went to trail for the texas crime he is serving time for that, Can the lawyer take care of the violation now or would we have to wait until he is released? and Do I find a lawyer in California or where I live since i am in another state also? also do you know what can happen? since this is a federal detainer I was told they work different than the state ...Thank you for the information
