Ex Wants Lump Sum Alimony Buy Out
My question involves divorce in the State of: NY
Received letter from ex stating that if I pay half of remaining alimony in a lump sum I would not need to pay any further alimony obligation. This would be in the form of cash only with no receipt for amount. A receipt stating the alimony obligation has ended would be given to me. Ex stated in letter that due to the current economic circumstances this would "help me out".
What is ex up to?? Would court order need to be changed?

If your ex wishes to modify the terms of your alimony order, let him/her take it to court. Otherwise this could be seen as a gift - it's certainly not legally binding (no matter what s/he writes on the receipt).

She wants a handful of CASH ONLY? Without a receipt as to the amount? With only a nebulous receipt saying that you have completed a court ordered payment plan without going back to court?
She is not only trying to rook you but to have you help her defraud the IRS.
A court order is exactly that. An order with the force of law upon those within. It cannot be changed or modified outside of a court of law.
This order is not a suggestion or guideline. Anything you give her can be considered a gift... and the court order can be brought back into force. In other words, you get to pay it TWICE when she tells the nice judge that she never got it... and that there is no record of her actually receiving it.
Tell her that you would be glad to have the funds placed in escrow with your attorney and to have her attorney contact yours as to the documentation. Once that documentation is filed in a court of law, you will have your attorney release the funds.
I will bet you will never hear of this again.
