Burglary Charge Over Fraud Reversal Transaction
hey guys, i need some help here please.
this occured back in the beginning of january when i was 19. A couple of friends and I were doing a fraud return (example: buying stuff on our credit cards, and one of my friend's friend works at macy, we would just give the receipt to her for her to clear it). Such a stupid thing to do i know, and i feel like crap since. since my friend that works there, i would have to grab her some stuff on my credit card as well, after doing it serveral times, it ranked up to be under $3,500 worth of merchandise. The LP made us sign a piece of paper for a fraud reversal transaction, meaning whatever i cleared will be put back on my credit card, i paid everything off within months. I did not have to pay for any civil demand because i called the place and they said i didn't have to pay for it. and now 5 months after the incident, i just recieved a letter from the court today for July 18.
this is what i am being charged for
violation of section(s) 459-460(b) PC BURGLARY SECOND DEGREE - COMMERICAL STRUCTURE - LARCENY 487(A) PC GRAND THEFT
can anyone please tell me the outcome of this? this is my first time, i just turned 20, and i have a clean record.

Get a lawyer, and try to get the charge reduced to a misdemeanor. You're likely to get probation, but a misdemeanor would likely have a much less profound effect on your record than a felony conviction.

i joined pre-paid legal, which was recommended by a friend.
i just got off the phone with an attorney from pre-paid legal, he told me that my 2 charges are very serious.
He told me to go on the court date to plea not guilty, ask for a public defender, show the judge proof that i paid off everything to macy's, may reduce sentencing, if it works out with a deal, i won't need an attorney, if it doesn't work out, i need to hire an attorney. wait a couple of weeks to get another court date. but the attorney i talked to said he knows the judges and the DA from Westminster Justice Center. But my court date is on July 18th, and the attorney i talked to is leaving on July 15th, which he is no longer working for pre-paid legal, and is willing to still work with me outside of pre-paid legal, he said he will work with me until the primary hearing for $2,500 up front. not to trial. Is this a good thing working with him since he no longer be with pre-paid legal? Should i ask for another attorney and see if i can get a better deal?
help me please!

You're going to have to decide for yourself if you wish to try to do this without a lawyer, with a public defender, or with a retained lawyer. That's ultimately a personal choice; if it were me, I would either retain a lawyer or get a public defender.

Hey guys! here is an update. it's finally over! i have hired a local attorney that was very helpful, well i went to court last monday. they wanted to give me and the other people involved 90 days in jail, but my attorney got them to reduce it to 100 hours community service to be completed by 18 months, and probation for 3 years. If i complete the 100 hours before a year and a half, they will drop the charges to a misdemeanor 17b i believe, and be off probation. The fines is $240 dollars. I think i got really lucky because my attorney said we had the right judge and DA on the right day! I'm glad this is all over, and i will never ever do anything like this again! thanks for reading!

If I were you I would report the first attorney to Pre-Paid. Sounds like an ethical violation to me.

well first i went to a local attorney which was way cheaper. the pre-paid legal guy that was quitting wanted $2,500, he was violating their policy because he told me not to tell anyone from the company, and i ask for another attonrey, he wanted $5,000 which i thought was an outrage, once i knew it was useless i dropped it. I called my local attorney which only cost $1,500 and i think it was well worth it. Don't join pre-paid legal in my opinion, also heard it was some kind of a pyramid scam or something.

There are prepaid legal programs which some employers offer as a benefit of employment (e.g., Hyatt Legal Services), which are different from the type you're describing. What you seem to be describing is the type of prepaid legal plan which is sold through multi-level marketing (MLM).
MLM is different from a pyramid scheme because, er, it's legal... (I'm half-joking. The focus of MLM is supposed to be the sale of the product or service, not the sale of the opportunity to sell the product or service, but in reality that line can be awfully blurry.)
