Shoplifting, 15, What to Expect
My question involves criminal law for the state of: Michigan/Indiana
I was caught shoplifting from jcpennys about a week ago. I am 15 years of age and have never gotten in trouble before. I was with a friend who is 17 we both took about $40 of merchandise each. The people took us to the back room and asked for identification&filled out forms about us. They asked us if we knew why we were there and questions about us. Other than that we said nothing. A police officer caame and all he did was make us sign a promise to appear form, other than that neither of us signed anything and they released us to our parents. It was in Indiana but I live in Michigan. What will this change? I just really wanna know everything that is going to happen from here on out... Help?!?! I have many questions
1. Does the fact neither of us had money on us change what will happen at court? Good or bad?
2. What can I expect as a civil demand fee? &should I pay it right away?
3. When I go to court what should I do?
4. Is it possible to get out of this going on my record? If so what kind of things would I have to do?
Re: Shoplifting, 15, What to Expect
Being an interstate fugitive neither hurts nor hinders you. You need to appear and you need legal representation. You can count on being called to court a couple of times (it's unclear which state you were actually arrested in, so I can't give you a more detailed answer).
Why would having money on you make any difference? It does not.
You can expect the civil demand to be a few hundred dollars (again what they can statutorily get away with depends on the state). You can roll the dice to see if they are going to sue you over it. I don't have experience with Penny's
When you go to court, plead not guilty unless instructed by counsel the implications of doing otherwise. If you can not afford a lawyer ask for a public defender.
You can absolutely bet it's already on your record.
You can expect a fine/costs and/or probation.
Where are your parents in all this?
