    Lay Off After 3 Years of Employment Instead of New Manager
    I am new to this forum and had read many forums here and found it to be very helpful and hope someone can help me here:

    I worked for company (B) for a manager and heard that company (A) has better management so I eager to work for company (A) for 3 years as an assistant manager instead of a manager. This is a profession field that you need to have a manager to report to the board of education. I thought I can work hard to get promotion to a manager soon.

    When I started work there in company (A), there weren’t any manger but other store’s manager to substituted as a manger.

    Because I was an assistant manager, the staffs didn’t bother listen to me. I tried to asked one staff to do something, she just left the place. I tried to talk to the HR, but they said I wasn’t the manager so I couldn’t fire her. We worked for different days from that day on. As this matter went on other staffs didn’t listen to me. I just worked as normal pace instead of keeping in 100% as in company (B). The score for the store was a little below average because there were no manager involved. There was a new VP started during my 3rd years. I could tell that he didn’t like me because he replaced other VP and didn’t give me bonus so I had a little argument with him. This VP transferred a staff from other department which she had no experiences in our field. She has no computer skill which she has difficulty typing her password and press Ctrl Alt Delete together. I have to walk her through 3 minutes to get her to press Ctrl Alt Delete together. She had to call the Tech support almost daily for 2 months to get her password changed every time. Of course when I wasn’t there the VP blamed me for not teaching her computer because we needed computer to work.

    They hired a new manger above me and tried to isolate me because they thought the poor score because of me. At the same time I was picked by court for serving jury duty for a long term, one day every week. Right after my jury duty term ended and because the economic crisis I got laid off last year for 3 years of employment.

    I was unemployed for a year after they laid me off. I am a minor. My question is can they fired me even I worked there for 3 years and not the new manager?

    The answer is yes unless you had a legally binding employment contract guaranteeing your employment.

    You should have furnished the name of your state.

    you're a minor and you had worked at this place for 3 years and unemployed for another year. That's 4 years so you are saying you have been working for these folks since you have been 12 or 13.

    Sorry about the delay. The state is NY. I meant Minority not minor, was late when typing this...

    Minority vs. Minor. Big difference

    If you're asking whether or not this is a legal termination, it is UNLESS you can show it a court of law that you were laid off (and not someone else) SOLELY because of your race. And this would be true whether your race was a "minority" one or not.

    and you were complaining about the employee that couldn't hit control, alt, and delete all together.

    When I started this forum, this forum told me what state you are in, I put it in before, guessing it was not showing.
    For the employee part, pretend you are running a CPA (public accountant) office. Your VP transferred a 60 year old genitor hope you could trained him to be like you a CPA within a week when you were off when temporary CPA around. You found out he has no computer skill. Is the customers score dropped down because of you not training the staff or because the VP hired an inadequate employee?

    Jk, I apologized before for replying late. I am not a native born here and my English is not perfect. Are you opinionated after I said I am a minority??? What are you trying to prove????
