    My question involves child support in the State of: Texas

    My question is in the State of Texas can a father give up his rights and still be ordered to pay child support ? I have a 1 year old daughter. Me & my ex-husband are seperated. He left me and my daughter. I am trying to get child support and when i told him he said he would rather give up his rights so he won't have to pay child support. Is that right ? Can he just give up his rights on his own then I am left without being able to get child support? Please help!! Thank you!

    Texas does not need a stepparent adoption in order for parental rights to be voluntarily terminated (unlike most other states).

    However, in order for this to happen YOU have to agree to it. Otherwise it won't happen.

    Go ahead and file for child support! Your child deserves it. He can still choose not to establish custody and visitation...that's entirely up to him.

    I agree with Dog. I was in a similar situation and an attorney advised me that if a parent could just file some document with the court to give up their rights the courts in order to avoid support the court would be handling thousands of requests daily.

    You will have to agree to such a motion. Go ahead and file with the Texas Attorney General's office today. It iwll take a very long time to get an order but you will get an order for support. If the other parent chosed to ignore the order then the Texas Attorney General's office can file papers with the court to enforce it. They will only handle child support issues, not custody or visitation .

    It is funny how many NCP believe that, when in reality, it is the total opposite. The more time he spend with his child the better chances he has of paying less.
