Who has custody?

i've lived with my aunt most of my life, my mother and father haveing given up custody. But recently my mother died and my fathers name isn't on my birth cirtificate.

Who has legal custody of me? I can't stay where I am at now, due to emotionl abuse. :confused:

yea she got custody, but that was befor my mother died and befor it came to my attention that my fathers name wasn't on my b/c.

If she has custody pursuant to a court order... well, that answers your question.

But that was befor my mother died, the only living parent to hold the custody agreement. Because the man that signed as my father, his name IS NOT on my birth certificate.

And that was my question, since both birth parents didn't sigh the papers are they leagl.

There was never a court hearing, jsut the signing of papers.

Would my grandmother have custody? Because I have to firure something out. I can't stay w/ my aunt any longer. We fight, and the emotiol abuse is horriable.

You stated that your aunt has custody pursuant to a court order. That would mean that your aunt has custody.
