Child Support Not Being Withheld
My question involves child support in the State of: Illinois
My X has a child support garneshment that has been in effect for over 10 years with the same company. In the beginning of this year they changed how they do payroll.
Since then they have missed taking out C/S twice from his check in the last six months.
X- has told me that he spent the money. He has also stated that he is broke and cannot pay me back what they did not take out.
Company refuses to speak with me :( Not sure at this point what to do?

Does the child support garnishment go through the state? In other owrds, your ex's company garnishes the money, send it to the state, which the forwards it to you. If yes., then you need to talk to the Child Support Services office and have them go after the company and your ex. This office is your friend.

Agreed. Unless the money is being sent directly from the employer to you, they have no obligation to talk to you and, as a payroll manager for many years, I can tell you that the great majority of employers will not.
Having said that, the court can hold the employer responsible for the amount they were ordered to withhold and did not. Contact the court or the state OCSE.
