Divorce While Living Abroad
My question involves a marriage in the state of:
Here is my situation: I am a US Citizen and now live in the Philippines. I want to file for divorce in the US...say Guam. Annulment process here in the Philippines is such a long process and not guaranteed. My wife and I are in complete agreement to get the annulment or divorce...we have no children together and no property owned. I have heard that if I were to file for divorce in the US and then my ex could take the divorce papers to be recognized/registered in the NSO or Court system here in the Philippines to make the marriage here in the Philippines null and void. We were only married last April/2009. Also if all this is possible...can I file for divorce online as opposed to spending money to just fly back to the US to file in person? I want to stay in the Philippines to retire.
Re: Divorce While Living Abroad
Guam has the requirement that you spend not less than a week within its borders before you qualify for a divorce under its laws.
Re: Divorce While Living Abroad
Thanks...yes I found out I would only be required to stay 7 days for residency. But my main concern is to be able use the US Divorce Decree for basis of annulment in the Philippines. That way I can remarry in the Philippines. The annulment process is long and very costly...and not even guaranteed because the Philippines is mostly Catholic and do not believe in divorce.
