Boyfriend Picked Up Over Immigration Violations - What Do We Do
Hello. My boyfriend is currently on a school expired visa, and he was picked up at his place of employment. I bailed him out of jail, and now we are waiting for a court date. If we were discussing getting married before this fiasco, and are still considering it now, is it going to make a difference before we go in front of the judge? I love this man, and want to marry him, but I don't want to be married to a man that lives on the other side of the world (Kenya.) Is he still going to probably get deported even if we are married? He has NO criminal record including traffic violations. Thanks in advance

Under the circumstances he should be speaking to an immigration lawyer.
How long has he overstayed? Is his visa stamped D/S? Has he been offered voluntary departure?

Getting married will not improve his status at all. If he is here illegally he'll be deported, even if he was married to a daughter of the american revolution. The amount of time he was here that Bullwinkle refers to only applies to how long he's going to be barred from coming back, but you can expect given the general circumstances that is likely to be TEN YEARS. VISA overstays are not flying under the radar like they used to.
