My question involves criminal law for the state of: Any state that has legalized Marijuana like OR or CA.
With the legalization of medicinal marijuana in many states, is it okay to sell the paraphernalia like pipes in stores or online? What about importing?
I see many sites online and brick and mortor stores selling but are they breaking the law?
California doesn't outlaw paraphernalia provide you don't sell it to minors and provided you have the appropriate signage banning minors.
The Oregon Medical Marijuana Act doesn't specifically authorize paraphernalia so it's technically still illegal (Oregon bans sale of a broad class of paraphernalia listed by statute). There is mixed opinions as to whether the act implicitly permit it for medical use.
