    My question involves criminal law for the state of: New York

    I've done a ton of research on this site, which has been very helpful thus far :)
    However, I still had a few questions about my case:

    Background: of age, I am not a NY resident, charged with petit larceny in NYC, this is my first time offense, I am a model citizen otherwise

    Questions

    1. At my court appearance, can I motion for an ACD myself? If so, will I have to bring any paperwork, or simply argue my clean background and unquestionable regret for the decision I've made?
    I ask this since I'd like to: a) avoid commuting into the city for a later court date with a public defender, since I live out of state, b) avoid getting a lawyer, and c) settle this mistake as soon as possible so I can move on in my life

    2. Is it necessary to go into court to ask for an ACD? Wishful thinking, but again, it'd be nice to settle this matter as quickly and cleanly as possible. My father is a lawyer if that helps at all.

    If your father is a lawyer, you should ask him what his advice would be.

    A lawyer general ask for an acd or one is offered,plead guitly and see what happens. Sometimes you can be offered a legal aide or just go in with your father and see if he can arrange an acd for you.An acd is meant normally for 1st time offenders and it's up to the da or judge. I would think you have a good chance at acd especially with a lawyer.
