Annulment for Fraudulent Marriage
My question involves a marriage in the state of: Missouri
I got married July 30th and soon found out things were not on the up and up-
I had to call 911 within the first month- (told them it wasn't and emergency, but what to do bc he was acting crazy) It became clear things were not good. We have been separated since Sept 9 -- I am in the process of getting a divorce (calling lawyers/getting advice) But He finally just admitted he just wants a visa And has offered to make me a deal if I stay married to him.
Can I get this marriage annulled? I really thought he was a good guy and we were going to have a good life.
(I never signed any of the immigration papers to keep him legal; his visa expires nov 30 - he is from syria)
Re: Annulment for Fraudulent Marriage
There is case law indicating that fraud is a basis for seeking an annulment in Missouri, but there's not a great deal of guidance about the type of situation you're describing. As you're already consulting lawyers about divorce, I suggest discussing with them whether they believe you might qualify for an annulment, as well as if it's possible to make the request in the alternate (ask the court to grant an annulment but, if the court declines, to have it grant a divorce in the same action).

Same thing happen to me in California. My divroce went into default and now she is doing everything in her power to keep it that way. A divorce is just as bad for him as an annulment. I gave the judge that same reason to set aside my default and he did not grant it to me. I am still in default with this women and she is still trying to gain her residency with it.

I haven't read your post history. But you did mention her gaining residency - frankly getting the divorce finalized may be the least of your worries.
