Breaking and Entering Second Degree Home Invasion
My question involves criminal law for the state of: Michigan
The day before yesterday, my fiancee was arrested "breaking into a house." I haven't been able to talk to him, to find out what is going on, but I have been able to find out he was arraigned and it is Home Invasion 2nd degree...I can't find anything about it online, I'm pretty stressed out, and I am hoping someone can give me some information. How long do people go to jail for this sort of crime?? Can the court give me his court date, or information like that, or how long he is going to jail???

Your fiancee is in a world of hurt and you should encourage him to get a lawyer. Usually court information is public information. Many courts have that information available online, you also may be able to find it by going to the courthouse and seeing if someone can help you look it up. THe online information usually is pretty terse. The court date may be only a preliminary hearing or some other event that can change before the prosecution really gets going so you should not rely on the information.
(6) Home invasion in the second degree is a felony punishable by imprisonment for not more than 15 years or a fine of not more than $3,000.00, or both.
Even the third degree is a felony.
