Attorney Error Caused Dismissal of Bankruptcy
My question involves malpractice by a lawyer in the state of: Texas
Can I file a Legal Malpractic LawSuit on my paid BR attorney for failure to file information (CREDITOR MATRIX) which made my Chapter 13 be dismissed and my only 2 secured debts were my house/truck.. My trucks was then repossesed and recently sold before the BK was reinstated !!!! I paid my atty. $1000 to file w/ $2000 to be paid in the trustee payment......now my atty. has refunded my $1000 and withdrew from the case !!!!!! This not only cost my atty. the filing fees but I lost my truck which i was only $600 behind ????????

You say "now my atty. has ... withdrew from the case" - meaning that this lawyer got your case reinstated and you continued to work with the lawyer despite the earlier problems? Your attorney's explanation for withdrawing from the case was what?
Your bankruptcy was apparently reinstated, so what is your complaint in relation to filing fees? How much equity did you have in the vehicles? Any other damages?

Tks for the reply.......My lawyer filed a motion to reinstate the BR 2 weeks after my truck was repossesed. It has now been going on 4 wks and the case has still not been reinstated. He refunded my $1000 and said he would be withdrawing from my case but has yet to do so as of today..... Now I recieved a letter yesterday that my has would be sold on DEC.7 2010 !!!! This is all because my Lawyer did not file the proper information. I have spoke w 2 attorney's about the malpractic and they both agreed that it is indeed Malpractic but both of them only handled malpractic $100,000 or greater. There was only $700 equity in the truck but it was sold for $2500 less than what I owed so I will be billed for that. Also there is a repossesion on my credit and i'm having a hard time getting another truck !!! He really got me good !!!
