Step Adoption without Bio Fathers Consent
How can my fiance adopt my 15 month old son without the biological father's consent?

I live in Michigan. The bio father's in California and hasnt seen my child for more than 10 days since he was born. He pays child support ($400/month) and says that he will be part of my son's life when he's older. Honestly I don't want him to be. He has played no part in my son's life so far and my fiance is a wonderful father to my son and he wants to raise him.

The bio father won't consent to my fiance adopting him after we're married. So how can I get around him?

If the biological father is seeing the child, even if occasionally, and is current with his support, you probably can't obtain step-parent adoption over his objections.

Is it possible to change my child's last name (his bio father's last name) to my new husband's name when we get married (or even to my maiden name) without consent?

Yes - but you would need the court's approval, which would mean convincing a court that the name change is in the best interest of the minor child.
