Received a Citation, but Did Not Sign It
My question involves a speeding ticket from the State of: North Carolina.
I received a citation, 60 in a 45, in Charlotte a couple days ago. The officer gave me the ticket but did not ask me to sign it. The box says:
Acknowledgement/Nonresident Personal Recognizance For Appearance
I acknowledge receipt of this Citation (checkbox) and I promise to appear in the named court at the time and place designated herein to answer the charge(s). I understand that my failure to appear or to dispose of this Citation by other acceptable legal means, such as waiver, will result in my operator's license issued by my state of residence being suspended until I have done so. Also, I may go before a magistrate and make bail in lieu of my personal recognizance. Date: Signature of Defendant:
I would think that I have grounds for dismissal since there is no evidence of acknowledgement of receipt of the citation. Any suggestions would be appreciated.
Re: Received a Citation in Nc, but Did Not Sign It
You would think incorrectly.
Lack of signature does not alter the material facts. And it's mighty difficult to argue non-receipt of citation when your "evidence" is the box on your citation.
Signing the ticket only acknowledges your promise to appear. It does not invalidate the citation.
