Prison Sentence Reduction Due to First Time Offender Laws
My question involves criminal law for the state of: Washington
My son was sentenced to 90 months on a plea deal. Is there anyway to have his sentence reduced due to first time offender laws ? It was not taken into consideration at his sentencing. What are the forms that need to be obtained to get this sort of process started.

The sentence is usually agreed to as part of the deal. There's no reason to take into account anything. The first offender rules are a "may" not a "must" for the court as well. There are a broad category of exceptions (violent crimes, sex offenses, drug manufacture/delivery, DUI) that are ineligible anyhow.

the charges were residental burg. four counts. With all the buget cuts with the DOC,how do they consider who to let out early ? any idea ?

Are you saying he had absolutely no priors (not even as a juvenile)? Seems plea or not there's something wrong with 90 months. Was this plead down from other charges?

Yes. absolutely no priors. and yes there were more counts of residential burglary and he was charged with 4 and one count of burg 1. There were like four guys involved and he was in court first and charged with the most and some he wasnt even envolved in.

there was a gun taken from a home but never used it. pawned it as far as i know
