Probation Violation
My question involves criminal law for the state of: New York.
Here is my issue; I am on felony probation for DWI, I have been on since 2005. I currently have 4 months left, now here's my dilemma, I have a job offer in Florida but my boss needs me there by this weekend. I asked my probation officer and he said I could not go because I have not paid my fine, ( which is close to $5000). Now if I stay here in New York I will not be able to pay this fine in 4 months and will be violated and go to jail, but if I go I will be able to pay it. Now if I go I understand I'd be violating probation and face jail time, what are the chances that they will come and get me? My plan is to definetley pay it but im worried that what I pay they will use to come and get me? I really need some feedback asap!! I have to make the decision in a matter of hrs. Also note, this career opp will NOT ever be available to me again in my company and can not wait 4 months for me to be off probation

Re: Probation Violation
So your PO is aware that you are interested in a job out of state? How long do think it will be before he does a surprise home visit or calls your home phone to speak to you? The unpaid fines are not the main issue here. If you leave the state without the court's permission, you can be violated for that. Will they come get you? That is anyone's guess but even if you pay your fines, that will not get rid of a parole violation warrant for leaving the state.
This (the lost job opportunity) is one of those far reaching consequences that come back to haunt people that chose to break the law.

Re: Probation Violation
Well here's the issue, I live out of the county that Im on probation with, with their permission of course. But he did contact my landlord of the situation and told her she is to call him if I do leave. He was going to do everything to help me until she stuck her 2 cents in because she does not want me leave, ( leaving her with task of finding a new tenant). So as you can imagine I certaining do not want to continue renting from her, she went as far as to ask the neighbors to watch me!!! So they would come get me based on my violating probation for leaving the state without permission? Does it cost them to come and get me?

Re: Probation Violation
It's impossible to say for certain if they would come get you. There would be a warrant for your arrest for the violation though. Every time you get pulled over or have any interaction with law enforcement that they run you in NCIC there is a chance that you will be detained until it is determined if the issuing authority wants to come get you.
If he has your landlord ready to drop the dime on you, you are basically screwed. He can then violate you simply for moving without permission. The landlady is being a bit overzealous but if you leave that makes her life difficult so she is going to make your difficult in return. Not nice but there are people in this world like that.
