Terminated Because of Having Surgery
My question involves labor and employment law for the state of: PA
I had a work injury that required surgery. No problems with the workmans comp. I used the 12 weeks of FMLA. I returned to work after that full time. 3 months after returning, I was injured at home, requiring minor surgery and expected to be back to work 4 weeks after surgery. The doctor released me to go back to work until my surgery date, but my employer said "no, we are afraid you may injure yourself worse". I was just notified i was terminated. No specific reason given. (non-union, no contract) We are at will employees. Is there anything I can do? My employee record was perfect, and was a full time employee for 11 years.

since you had already exhausted your FMLA, they could have terminated you the first day you missed. You have no protections and as such, can be discharged.
