Marijuana Possession Charge - What Should I Do
My question involves criminal law for the state of: Michigan
2 friends and I were smoking in my car parked in a parking lot. A police officer pulled up and asked us what we were doing, etc. He said to me that he saw me smoking something, and asked where it went. I told him I didn't know. My friend behind me handed the police officer the pipe and his bag of marijuana. He had another officer come to the scene considering there were three of us. He asked me if there was anymore I told him not that I know of.
He searched me, my friends, and my car. There was nothing on me or in my car. One friend had a little more than a half an ounce, a pipe, and a grinder. The other friend had less than a gram or so on him. They didn't impound my car or anything. Gave me and the guy with the small bag Use/possession tickets, and the other possession and 2 accounts of paraphenilia.
My court summon I recieved says that I am being charged with possession and my court date is this Wed. I did not get an attorney, because I going to college and working part time can't afford one. A court appointed attorney I couldn't get either because my mother didn't tell me I recieved my summon until less than a week ago.
The other officer was asking us how long we had been smoking for, what we were doing with our lives, etc. So much for my criminal justice major. :wallbang:
I am wondering how I should plead? What I should do in general.
Any help is greatly appreciated.
Re: Marijuana Possesion Charge - What Should I Do
Plead not guilty unless you have been assured by counsel of what will happen if you do otherwise. Despite the fact that you have acted stupidly in every aspect of this situation, beg the court for the chance for appointed counsel.
You are however, as they say in law school, guilty as hell.
