Parent Absent for Visitation Using Substitute
My question involves a child custody case from the State of: Ca
NCP Parent has every other weekend visits. Now is employed traveling all over the US. Contracts are around 3-4 mos then onto the next job.
I asked about the weekend visits and he said he would do them or a member of his family would.
Im just curious on if this is regular can a parent have a substitute for his parenting time? Isnt the purpose to be with there father?
Also what if a girlfriend is this substitute, he is not giving me a straight answer or telling me who is arriving for the weekend pickups. This last weekend it was his girlfriend.
We do not have First Right of Refusal
How does a girlfriend come into play when Im home to care for them and hes not?
Re: Parent Absent for Visitation Using Substitute
He can let anyone he chooses take care of the child during his parenting time.
You might consider petitioning for a modification of the parenting plan if this is causing your child distress.
Re: Parent Absent for Visitation Using Substitute
Does your court order say anything about a known 3rd party picking child up at meeting place? Or can just father do the pick up?
If the answer is that a 3rd party can pick child up, then I say you need to file for a modification asking for either a ROFR or that his days be cut due to his job.
ETA: His days be cut, but offer to make them up during a vacation period he may have coming up or Christmas time, or something of that sort. You should still want the child and father to have a relationship even if Dad has a crappy work schedule that makes him miss his weekends.
