My question involves criminal law for the state of: NC and MA
sorry this is so long but any advice would be greatly appreciated
So here is my situation I got caught shoplifting in Walmart the other day while Ive been living in NC.. I got caught stealing about $50 worth of arts and crafts to make in memory necklaces and bracelets for a friends and her family for someone who had recently died in a car crash.....
I'm from MA and Ive been in NC for about 8 months ... right before i had came here i had a shoplifting charge for stealing food/sub from a store (i know pretty petty but i was homeless and didn't have any money to eat so when i got caught the cops summons me to court and since i wasn't living anywhere at the time just jumping around i told the officer to send the letter with the court date to my old address and i was never told when the letter came with my court date from old roommate... So i have a warrant for that.. when i had called a court house in MA i was told I had 3 warrants..
im guessing i have one for check fraud maybe because this "friend" of mine lied and BS me .. he had a check and ask me if i could cash it cause he didn't have his license on him.. this "friend" owns 2 houses and has his own electrical company. He always had alot of money so i trusted him ..He told me His company partner was out of town and he pulled out a check that was his partners and wrote it out for 1600$ .. you mite be thinking im stupid but he was very manipulating and told me before they always borrow money of each other when needed. So we go to the bank and the banker ask to see my ID then told me the check wouldn't go threw but they must of knew the check was not right probable cause he wrote it out to cash and not MY name. He even made a fake phone call in front of me acting like he was talking to his partner and he said "ok well ill just write it out to cash and not his name cause he doesn't work for us. I couldn't believe this so called friend would do something like this to me. come to find out he had been in dept and had a very bad addiction to Oxycontin that he had been hidding from people for over a year..The bank gave me the check back and i still have it with his handwriting on it. He had ended up going to jail for a few months after this for theft... But were im from the cops probably wont believe me . But i really was coned into this whole thing 100%
so about 2 weeks after this happened i had moved down to NC with my mom because my life just wasnt going to well and my mother has heath problems and figured i would come down to NC for a while. people started calling me about a week after being down here that cops are looking for me about this check and i have warrants. Im almost positive I didn't have any warrants issued till i was already here. (I flew down here to NC with no problems at the airport) ..there is a possibility i may have another shoplifting charge on top of it because i was told i had 3 warrants in MA
then just a few months ago i was pulled over in NC for a license plate tag. I got 2 warnings then ended up getting a court date i missed!!!. i didn't even know what the hell a tag was we don't have them in MA ( i thought it was just like an inspection sticker) But my license has been ran by cops about 4 times in NC and My warrants in MA never show up..
When they run my name they have not said anything about missing court here either and i thought i would have a bench warrant. Im just worried as hell as i have a few different server anxiety disorders along with depression
The Thing is when i go to court in a couple months For the shoplifting at Walmart a couple days ago that they are going to see my warrants in MA and already missing a court date down here for he tag.. Its all going to show up and blow up at once and look really really bad. Probably going to want to extradite me : (
I do have a little record but have not been in trouble for a few years. I have driving on a suspended license 2 times, destruction of property,prescription of klonopin without my bottle but that got dropped in court.. and one time it was a wrog place at the wrong time i showed up at a friends house and didn't know a kid had 4 ounces of weed right behind him while 6 friends were playing poker and i just got there and the kid it belonged to would not fess up to it so we all 6 of us got charged with it and all got 6 months probation
i know NC the laws and penalty's are a lot worst then in MA ... in MA they give you a slap on the hand and down here the throw people in jail for anything
Questions...
Can the state of North Carolina do anything about warrants in MA im sure there misdemeanors?
Will all this show up in court even though when ever my name is ran by police nothing shows up?
could NC charge me for warrants in a different state and use them against here and make me do time here?
Do you think i should go back to MA and clear up my warrants because the court system isnt as strict as here down south?
... its just i would feel awful for my disabled mother that needs me But i think either way im going to jail : (

Sure, they can extradite you if MA requests it.
Yes, the prosecutor will have pulled you in NCIC so he will see everything.
No, NC cannot charge you for the warrants but they may be able to get them entered to show you as a flight risk so if you plead not guilty and request a trial, expect a large or possible no bail...to make sure you show up. They may also be able to use them during sentencing to get you actual jail time.

Yes, its going to be hard on your mom but YOU got yourself into this mess....get yourself out.

The warrants are always gonna be held over your head,it best to just turn yourself in and face the penalty,then get on w. your life.

You need a Criminal Defense Lawyer, IMMEDIATELY.
It's gonna cost money, but you have a LOT of legal problems that need to be addressed before they get worse.

Yes, you do know. You just explained everything you did in your first post. Think back and retrace all your missteps. Remember them and do not do them again.
Especially, do not willfully commit another crime while you already have warrants on you. Do not attempt to shoplift. Get your vehicle registered. Do not drive around speeding, do not carry around drugs without a prescription on you, etc. Be 100% legal until you get these matters resolved.

No, as someone already told you, contact a criminal defense lawyer immediately. Do not do ANYTHING else until you speak to a lawyer first.

Your situation has nothing to do with luck, good or bad. It is simply a matter of you making poor choices and getting caught.

I have a funny feeling you aren't going to get the choice but if you do, I would suggest following whatever restrictions are placed on you by the currently involved court. If they say do not leave the city, county, or state, you abide by that restriction.
If they do not restrict you, I would still suggest taking care of the current situation first. When you go there, you will likely end up in jail. If you have not finalized the situation in the state you are currently in, you will end up with more warrants and charges.

Stealing is wrong regardless,especially if it's a small store you are effect the little guy,even the big stores it just makes prices higher and can affect the employees as well. I'm sure u have good in u and u did wrong but ain't the devil. Once u get up to the 2nd and the 3rd and counting for any type of theft conviction jail gonna be a possibility. Even in places where the judge or da cuts people more slack. Keep in mind I think your state can keep u in jail for a week- a month maybe then decide most likely not to extradite b.c the charges are not to serious,every run in w. the cops can cause a night or more in jail.
It's best to just try and contact a local lawyer their for a phone conversion (sometimes this can be free for the 1st one) and see what can be arranged, u screw up and got a few charges which is not good. The most likely are misdemeanors,just take your lumps then u don't got hold stuff over your head or worry about that crap. Be glad all the charges are in MA where the penalty is probably less serve.

please don't disrespect my mother she is the most important person in the world to me and was once a strong women that raised 2 children by herself after my father had past when i was an infant and now she needs someone to help her with everyday things.. and i don't plan on using that in court ether ... I'm not looking for sympathy.. i had came down here for a visit to find out my mother was a lot more sick then she was telling our family because she didnt want me and my brother worrying while she was 1000 miles away ... and these petty thefts are my fault and i take full responsibility and i didnt have warrants when i came down here and were issued after i was here besides the one from Walmart the other day.. back in MA i would try to keep jobs but would end up getting fired for not having transportation and being homeless jumping all around..trust me i know i made alot of masakes when i was younger and the biggest one was not seeing a psychiatrist/concealing for my social phobia while i was in high school because i dont have a high school diploma... also the crimes i have listed on my record were mostly from when i was 18-20 and i am 24 now and i have no felonies
now im not trying to use this as an excuses but wre im from the cops are very crooked...
the town i am from the cops have nothing better to do then try to harass kids.. i cant tell you how many times Ive been pulled over and searched for no reason and let go and have cops say to you "everytime I see you im going to pull you over and search you ..
seen a cop pull a friends sweatshirt hood over his head and punch him in the face and broke his nose and eye socket while he was already cuffed just because he was trying to pick up his kid and his g/f at the time called the cops...
another time they told a girl i had just started hanging out with they had to search her car because i was in it and im a known drug addict because then they would always randomly search me and see my prescription anxiety meds on me and the one time i had got pulled over with my friend and had 2 of the pills in my other blood pressure med bottle and arrested me when he had known from the past i was prescribed to me (the judge was actually aggravated at the cop for arrested me for that) that was dismissed but still on my record
.... they let a cop back on the force when he was charged for raping a women that he had pulled over and recently got promoted to a detective
when the cops showed up at a friends house to pick up a kid on warrants and they knew i had just got there and pulled in as i was walking down the driveway but still charged me and 5 other people with 4 ounces of marijuana when it was directly under the persons seat it belonged to and charged all of us with the full amount because my friends were playing poker and they said that the weed was the winning "pot" literally.. the judge shook his head and laughed when the cops tried charging us for illegal gambling they didnt find any money so thats why they tried saying the weed was the winning prize ...
Never mind that in the past 5 years they force has killed 2 teenagers with police brutality ...
a few years back the town was trying to get a whole new police force because of all the harassment to all the kids but the town didnt have enough money to do it
when you live in a town like this were ever kid has a record and they know every kid by name its impossible to stay out of trouble
the list go's on and on but the one thing i thought was funny is when i had not had a lisence for a year and had just paid to get it back and within 20min of having my license i get pulled over and the cop said "what are you an idiot Mr. ------- (me) step out of the car your under arrest i said for what he said your driving without a license... i said to him i cant even drive back from the DMV without you guys pulling me over .. the cop then says well have fun while you have it cause ill be taking it by the end of the summer..

it seems like im just being bashed on this website... i came here just wondering why when my name is ran my warrants weren't showing up and a few other things.. i do realize i have to contact a lawyer to find out the write answers and i plan on doing this on Monday but when i signed up for this site i thought there may have been a lot of lawyers on these forms
and for the other person saying I am blaming everything on the cops well around my area they are all scumbags besides a few that i respect and anyone from my town would say the same ... there are even websites about my town and how horrible they are and people trying to get together to get all new officers because of all there actions witch almost happend a few years ago ... as you would only understand if you were from my town and im admitting to my crimes and i dont consider myself a a crazy criminal
but like i said i will be contacting a lawyer on monday ... but i had just told my whole story and situation because i had thought there may have been lawyers that come on here and could give me some good advice ..i also apreiate anyone that is resounding to this and i thank you guys ... it looks alot worst then what it is .. Im really a nice person and i do anything i can to help people and i may have just made myself lookthat way because i came on here and told you guys all the things Ive ever done wrong

my point was; although your mothers condition is a recent situation, it could have happened at any time. We have no promises we will wake up in the morning. Yet, you still committed crimes that could result in jail time. Your lack of vision then is what is causing the problem now. You should have considered your future, and what might happen, when you broke the law. You can't turn back the clock and due to your actions, it does appear your mother will suffer. It's a shame but who really is to blame for your situation?

warrants seem to be able to hide sometimes. I have heard stories similar to yours where a person was stopped a dozen times by the police and apparently no warrant shows up. Then, for no known reason, the next time, the magic warrant is there and off to the pokey they go. Nobody has ever been able to explain well why it happens.

that may be but for the most part, you admit to committing crimes. Now, if you were living clean and had problems, then you have a real gripe. Once your name is in the system, you get special attention from the police.
hopefully the bad cops will be brought to justice. Yes, it is a tragedy when an entire department seems to be bad guys. It isn't fair but because of that, it would seem a person would go the extra mile to stay clean.

Dude....you are blaming it all on the cops, and not taking one little bit of responsibility for YOUR actions.
You have admitted to many crimes.
If you were so concerned about how your mother would be affected - well, maybe you should have thought about that a lot sooner.
Man up and take responsibility for your actions. When I shoplifted, atleast I could admit I messed up and learn from it.
OK...so you have described your charges:
- Shoplifting food/sub while homeless (for the future, may I suggest Food Banks or Homeless Shelters?)
- Check Fraud.
- No license tag (MA must be the only state not requiring one)
- Shoplifting at Walmart in NC.
- 2 counts of Driving on a Suspended License.
- Destruction of Property
- Drug charge.
- Failure to appear in court.
How are these the fault of some mean, corrupt police officers? I'm sorry, but you said YOU stole the food (I'm sure the mean cops did not plant it on you). You gave them an address you did not reside at - sorry, not your former roommates fault that you never received mail.
I'm sure the police did not plant stuff on you at the WalMart.
I'm sure they did not plant drugs on your friend.
And I'm sure the police did not make you miss a court appearance.
Grow up and take responsibility for your actions.

No one here is trying to bash you. If you came here for legal advice, then please keep the questions about the law.
The problem that I, and I think everyone else, is having with you is that you are surrounding all your questions with pages and pages of explanations, talking about your ill mother (I wish your mother well, by the way), and about the crooked cops, etc. Honestly--and I am not saying this to be rude or disrespectful in any way--we do not care.
We will help you with any legal advice you may want and that we may be able to answer, but please stop posting full-page responses with more stories about how good you are, how you were screwed over, etc. You keep saying "I'm not using this as an excuse, but..." and then you go back into another full page of excessive information that is not going to help your situation one iota.
If you want help, then please help us to help you. If you come here and you simply state the charges against you and ask for help, we are not going to judge you. I myself have been caught shoplifting and I came on this forum to talk about it. None of the crimes you allegedly committed makes you a terrible person. You may have made some poor decisions, but we all do that. So what everybody is telling you is just take responsibility for the poor decisions you've made, and we might be able to help you from there.

The warrants seem to be for low level misdemeanor offenses. They are not likely in the NCIC system. Therefore, they will not necessarily be visible in NC. However, if the prosecutor or the courts review your Massachusetts Criminal Record, they may see the court defaults there. Massachusetts usually does not extradite for minor misdemeanors.

thank you that is one of the most things i wanted to know...But im sure they will check once im in court because i don't actually live in NC so i would figure they would def check my record and for warrants in MA... dont you think so?
I also don't know if you get multiple charges of the same thing that the could make it into a felony... can they?

well finally got out i had stayed out of trouble for about 4 years ..all my other charges were from 18-20 and im now almost 24 and the shoplifting charge in MA and the check situation happened within one month and i was told i was under investigation i think because of the check so i knew i had to get away for a little while as i knew there would probably more trouble to come...I was also told that the police had thought that i could have possibly been involved in something about stolen jewelry (witch i wasn't and think they know that i wasn't now) ... and a visit to NC kind of turned into moving here.. sorry for listing all of my old charges,new chargers,and my life story lol.. but i just thought it would help you guys maybe think what will probably happen? ....also from what i heard is just the state of NC will throw you in jail for just about anything
for now on i will try to only ask just questions , I just didn't know how this site worked as i have never been on it before and now looking around i see that people don't explain every detail and all .... so for now on ill try to keep it short and hopefully i can help some people out on here too
