No, they don't "get away with it". They get caught, charged with murder, and they go to prison.

Without delving into specifics, there are two principals that exist in most states: Misdemeanor-manslaughter and Felony-murder. These ascribe manslaughter and murder charges to any incidental deaths in the commission of misdemeanors and felonies respectively.

most states ascribe to a response of reasonable force compared to what the person is confronted with. That would mean, unless you are in fear of your life or serious injury, your response would be limited to non-lethal means.
Many states require a person to not take action once the threat of death of injury has been removed such as, once they attempt to escape, you can no longer use lethal force. In other words; once it is no longer defensive, you become the criminal should you act with unjust force.
Of course there are some exceptions to these rules. They are generally relegated to actions within the confines of one's home or associated lands.
