    Who Brings Embezzlement Charges
My question involves criminal law for the state of: WASHINGTON

My question involves a co-worker who was fired for embezzeling more that $250K. She has moved on to another employer who knows nothing of her past and my employer has not pressed any kind of charges or involved local or state law enforcement, most likely because he fears what she may say about him.

Who brings charges against an individual for embezzeling this kind of money?

If law enforcement is made aware of this will they pursue it without the victim pressing charges?

What is the best way to make embezzlers new employer be made aware of her past?

Your employer is willing to let 250K go because of what she might say about him/the company? She must have some Grade A dirt. Now, unless she can substantiate anything she might say about the employer, most will view it as retaliatory for pressing charges. If she can prove the company has been naughty and get them in legal trouble, may be best to let sleeping thieves lie. I'm guessing she didn't use ya'll as a reference?

A person makes a complaint to the police, who investigate it. Were it $100 bucks and the victim didn't want to do anything, they might let it go cold. 250k? That's a career case for some people. Once the complaint is made, if evidence exists to prove in guilt in a court of law, a prosecutor acting on behalf of the state will seek a formal indictment.

The best way to inform the new employer is to file a complaint and seek charges. Anything else could run afoul of employment law which would allow the embezzler to get even more money from your company when she sues.

Actually I'm no longer working for that company either, I left to form a new group as the company owners less than legal or ethical behavior was something I did not want to be a part of.

Does it matter who makes the complaint?

Is the complaint made in person? In writing? Anonomously?

Is the complaint made to the local police, local prosecutors office or to the state prosecutors office?

What kind of involvement does the person making the complaint have in the process once a complaint is made?

What kind of legal exposure does the person making the complaint have?

The complaint must be made by the victim ,or in this case where the victim is a corporate entity, by its authorized agent like your old boss.

I dont understand what the word 'equal' has got to do with the crime statistics you have presented in your question. I do however know that everybody is equal. Nobody is better than the other. HOWEVER if Thabo Mbeki can spend such a fortune on a retirement home he is not equal with us but a terrible leader. We have other people who could do with just a R100 in SA but he still insists on having a great retirement. Selfish if you ask me.
