    Duval County Florida Responding to a Summons
    I received a summons "In The Circiut ?Court, Fourth Judicial ?Circuit, In And ?For Duval County, Florida" for Child support, and DNA.

    I do not deny my son, is mine. I have to sneak money to Kierra for my son, because Kierra's mother will not let me give anything to Kierra for my son.

    I have purchased for my son Ta’ Quan.

    The list of items include the following;
    Crib with bumper pad, bedding, and mobile
    2 - 30 gallon size trash bags full of clothing & bibs, in sizes newborn to 12 months (I built up the clothing while Kierra was pregnant, my family purchased some as well)
    Baby Swing
    Car Seat
    High Chair
    Jumper Play Station
    Tub with Toiletries
    Walker
    Stroller
    Baby Monitor
    Diaper Bag
    Blankets (My mom made one and 2 other family members made one each as well)
    Toys

    Which Kierra's mom will not let me give to her. My son is now 7 months old and i have only seen him twice. I can not aford to pay an attorney, the lump they want up front. I hope there is one out there that is willing to take my case and let me make payments to them. I get paid every other week.

    I have asked Kierra to marry me back when she was pregnant. She has said yes, and wears the ring I gave to her. We are both very aware of the 2010 Florida Statute Title XLIII Domestic Relations, Chapter 741 Marriage; Domestic Violence, 741.0405 When marriage license may be issued to persons under 18 years. As it states in subsection 2, The county court judge of any county in the state may, in the exercise of his or her discretion, issue a license to marry to any male or female under the age of 18 years, upon application of both parties sworn under oath that they are the parents of a child. I have included a copy of the Statute printed out from the Official Internet Site of the Florida Legislature (http://www.leg.state.fl.us).

    Kierra is 17 and will be 18 in Feb. 2011.

    I would like for someone to tell me how to submit the responce I have written to the current summons, I was just sent. I can send them a copy attached to an email for review. I hope and pray someone will help me.

    I'm not sure what you're asking - are you asking if you and Kierra can marry without her mother's consent?

    Are you asking about separate visitation?

    Please help us help you :)

    Well the first thing I need to do is reply to the summons and I do not know how to do that. I would like to have an atturney help me, but need one that will work with payments for services. As i can not afford the lup sum most are wanting.

    OK, first things first.

    The site doesn't provide referrals; but you can go here to see if you can find help in Duval County.

    There are also many FL family law forms right here.

    If you don't qualify for Legal Aid/low cost help, call the FL Bar Association; there will be a local number in your telephone book.

    I have typed up a responce to the summons and need for someone to review it before I submit it to the courts. I also need to find out how I go about submitting it to the court.

    Again nobody here can review it before you actually submit it; you need to make sure you understand how to properly complete and submit the forms yourself.

    If you cannot afford an attorney and don't qualify for legal aid you're going to have to do some hard work yourself, and learn how it all works.

    Millions of us have to do it every year :)

    My local legal is not taking child support cases. I looked at the websites and I truly do not understand what I am to do or how.

    When I got the summons I called the number in the pages and they told me just to write something and bring it in to the the State of Florida's Atturneys office.

    To whom it may concern,

    I am responding to the summons in which I received on Friday September 3, 2010. Concerning Kierra **’ **** ***** and State of Florida, Department of Revenue (Plaintiffs) vs. William ***** (Defendant), case number ***** .

    I have never denied my son Ta’ Quan ***** born on 00/00/2010 in Jacksonville Florida. I am his biological father, and I accept full responsibility, for him as his father.

    I have been trying to take care of my son and his mother Kierra ***** , since I found out she was pregnant. I bought Kierra clothing while she was pregnant. Kierra’s mother Chonchita ***** , would not allow me to give the clothing to her. I had to have my parents take them to Kierra’s grandparents house, in order for her to have them. The same is true with everything I have purchased for my son Ta’ Quan ***** .

    The list of items include the following;

    I have since had to give away 1 full 30 gallon bag of clothing as Ta’ Quan will not be able to ware them as he has grown. Due to Chonchita refusing to allow me to give them to Kierra for my son Ta’ Quan.

    I have been giving Kierra money to help out since she was pregnant. I have to have a friend deliver it to her in school, so Kierra’s mother will not know about it. As she has been refusing to let me give anything to Kierra, for my son Ta’ Quan.

    She will not allow me to see my son, or Kierra either. As it stands I have only seen my son twice since he was born.

    The last time I had money given to Kierra was on Thursday September 2nd, 2010 in the amount of $100.00. It was given to her for me by a mutual friend named Darren., during school hours.

    I have asked Kierra to marry me back when she was pregnant. She has said yes, and wears the ring I gave to her.     Needless to say Kierra’s mother Chanchita will not alow Kierra out of the house so we can, apply for the license to marry. I am formally requesting that the court take into consideration at the time of the future proceedings for the summons in which I am responding to, to allow Kierra and myself to apply for a license to marry, and the court take it into consideration, to issue the license for Kierra and myself (William) to marry.

    I currently work Fulltime night shift at Walmart Super center located at 000000 ***** Road., Jacksonville, FL 32218 phone (904) 000-0000.

    If Kierra and myself are allowed to marry we will be living with my parents, in their home (which is where I live now). I currently pay $250 to my parents to live with them. My parents have agreed to allow Kierra, Ta’ Quan, and myself to live with them, until my 23rd birthday, which will be on 04/18/2014. I will have to pay $150.00 more for all of us to live there with them, to cover the extra food and utilities that will be used. If we are permitted to marry, Ta’ Quan will be in his crib, in the same room as Kierra and myself. By March of 2011, my brother Rodger will be moved out, and in his own place. At which time, Kierra and I will move into his old room, and Ta’ Quan will have our old room.

    Living with my parents will enable me to provide Health Insurance for Kierra and my son Ta’ Quan, through my employer, once I become eligible for the benefit. It will also enable Kierra to finish her high school education, and collage degree. I to will be able to obtain my collage degree, at the same time. As we have full support, and help as needed, from my family. While Kierra, and I are living with my parents, I will also be working on securing us a house of our own through Habijax. Both Kierra and I will also obtain our drivers license, during this time as well.

    If Kierra and I are granted permission to marry, it will by no means cause the alienation of her family. In fact I hope and pray that her family would be there for us as a couple, and be a line of support for us as well if we ever need help with anything. I do not mean financial help. I do not wish, to alienate her family as they have alienated me, through all this. My family and I are forever connected to Kierra’s family, as now one family through Kierra, and my son Ta’ Quan. We want our son to have the benefit of his whole family not just, a choice few, from one side or the other.

    The past is the past and needs to be left there. The future is our son Ta’ Quan. I hope that Kierra’s family will see this way as well, and do what is in the best interest of Ta’ Quan. As it is always in the best interest of a child to have both mother and father.

    I thank the court for taking all, that I have put forth in this response, into consideration.

    Your typed answer is not going to do it.

    If you are pro-se, representing yourself, you have to use the family law forms that can be found at the links already provided for you.

    First, you'll need to file your answer and counter-petition for parenting time.
    You can use form 12.983(c) for that. The instructions with it are very easy to understand.

    You'll need to read up on the laws in chapter 61 of the statutes, whcih apparently you've already found the site for that.

    You'll also need to know the civil rules and family law rules, here are links for those:
