Disorderly Conduct Outside Club in New Jersey
My question involves criminal law for the state of: New Jersey
I was at a club/bar in New Jersey. There was a small incident which lead me to get ejected from the club. It is a popular club and there are always at least 5 to 6 police officers outside the entrance. Once I got ejected an officer approached me telling me to leave the area, I tried to explain that my friends were inside and they were my ride as I did not drive. I asked the officer if he could go inside or get security to notify my friends so I could leave the area. I had nowhere else to go as I was not from the area. The officer was not helpful at all. The officer told me I was blocking the entrance and I complied and moved away from the door. I tried to call my friend that drove but his phone died so I tried to re-enter the club to find him so we could leave. The officer told me I could not go inside and once again I tried to explain I needed to get my friend so we could leave. I left the area again and came back a few minutes later and tried again. At that point I was arrested and charged with 2C: 33-2A (1). The police do not know what happened inside the club, they just saw me getting escorted out by security. All I was trying to do was to get my friend so we could leave and I ended up being arrested. I have never been in any trouble in my life. I am about to graduate college this semester with a criminal justice degree. I am a good member of the community and have been a volunteer in a fire department for 5 years now. After I was released I went back to the police station and asked to speak to a supervisor to explain my charges. The LT said I should plead not guilty and apologize to the officer at court and they will drop the charges to a municipal ordinance violation or something like that and it is just a fine. I still want to get a lawyer to be on the safe side as I cannot have this go on my record because I want to get involved with law enforcement. Do you think this can be dropped because it is not very serious and since I have a 100% clean history? Any advice or thoughts? I did not harm anyone, all I wanted to do was leave but I needed to get my friend so we could do that.
Thanks in advance for your help.
Re: Disorderly Conduct Outside Club in New Jersey
You were instructed to leave. You refused. You were again instructed to leave. You moved away from the door, then attempted to reenter the club. You were yet again instructed to leave. You pretended to leave then attempted to reenter the club. It doesn't matter at all what happened inside the club - you're charged because of your conduct while outside.
It's possible that the charge could be dropped or reduced. Your odds likely improve if you have a lawyer, and if the officer believes your apology.
