    My question involves criminal law for the state of: Illinois

    Hello - I live in the state of Illinois - in which the age of consent is 17. My girlfriend is currently 17 - and turns 18 April 2011. I am currently 20 and turn 21 in January of 2011. We aren't sexually active at this point in time, but have been discussing it.

    Earlier this year - January or February or so (shortly before I met my current girlfriend) I randomly asked one of the local law enforcement officers, just out of curiosity, what the age of consent is in Illinois. He informed me that not only was the age of consent 17, but that that particular age limit only applied to people under the age of 21. Therefore, by his reasoning, sex will be legal for us until I turn 21, and then illegal for a few months until she turns 18. I thought this was interesting, but I didn't look into it any further, because I had no reason to at the time.


    Recently, I've been re-researching this law on the internet and such, and on no website have I found any clause that states that the consent age of 17 becomes nullified if the partner is 21 or over. I've found a few articles that say that the limitation is 5 years over the underage person for a few different states, but none stating that 21 is the barrier age - Illinois or otherwise. Did the officer have his facts mixed up? Or have I just been missing this?
