Driver Switch After Getting Pulled Over
My question involves criminal law for the state of: Iowa

Need to know what criminal charges could have possibly happened with this situation. Boyfriend and girlfriend are driving on interstate, boyfriend is driving...he is driving at least 15 over speed limit (60), illegal lane changes, basically reckless driving. Another vehicle calls and reports this behavior. Law enforcement locate vehicle and follow them, pull them over eventually in a residential neighborhood. Boyfriend's car has dark tint on back window(s). Before cop turns spot light on (only has flashing lights going)...boyfriend has girlfriend switch seats as to make it seem she was the one driving. This goes unnoticed by the police officer. Girlfriend gets stern talking to, field sobriety tests (passed), basically gets the sh*t scared out of her....and in the end the officer lets her go with no tickets. My question is what criminal charges could have occurred had they been caught for switching drivers....???

One other thing...boyfriend has terrible driving record...on SR22 insurance...girlfriend has clean driving record. Hence, the reason for the switch...

And yes, girlfriend was stupid for even putting herself in this position.

However, it couldn't have ended better.

One possibility would be obstruction of justice.

If the girlfriend doesn't want a felony record she had best reconsider this type of conduct.

If the boyfriend asked her to do this, she should reconsider the relationship.

I fully agree with this post. An obstruction charge would be very bad for the girlfriend. How they managed the switch without notice is beyond me, but they were lucky in that sense.

    Self-destructive behaviour leads to self-destruction o.O

Very lucky in my opinion - must have been extremely tinted windows. Which is actually against the law in Iowa in it's own right. So lucky it was at night and the cop didn't notice this either.
