Help with simple assualt charges
Hello, My name is April and I have a question I was hoping you could answer for me, thank you:
Monday evening my husband, who is a recovering alcoholic, slipped up and got drunk. He came home from the bar and we got into a big fight over him drinking. He pushed me several times, tackled me to the floor and broke my cell and the house phone. He really scared me because when he's drunk he's not himself, he becomes violent. Anyway, I went to my parents home, my dad saw a red mark on my upper chest, called the police, and since i had visible evidence there was nothing i could do. He was arrested, realsed on bail and his hearing is sceduled for june 7. Until then there is a no contact order, his mother said he is getting a lawyer to try and lessen the punishment. He's never been arrested before, he volunteers in the community every weekend, and we have a 12 month old baby. What do you think he may get as punishment. I'm scared he'll get jail time. Also, is there anyone i could talk to like someone in the district attorney's office to try to explain to them he's not dangerous and maybe recommend probabtion and a fine?? Please some advice would be very much appreciated. Thank you P.S. we live in PA

If he has no prior record, he may be eligible for a diversion program - if he doesn't know if such a program is available, that's something he should explore with a local criminal defense lawyer.
He will most likely end up on probation, probably with an order to abstain from alcohol and possibly to participate in alcohol counseling, anger management, and/or an AA-type program.

I agree with Aaron. If this is your husbands first offense, and he does good on probation, the judge might have it leave his record after probation.
If your husband pleads not guilty, the punishment will be worse if found guilty. I would not try to fight it if I was him. I'll plead guilty for less punishment because it seems like something he can't win on.
