Getting roommate to move out without complications
I live in a townhouse with 4 others, and there are only two of us who have decided to stay and renew the lease (both of us are on the current lease). I want to stay in the house (I've been living in the house for 3 years) and I want to kick the other roommate out (he's only been living in the house for about 8 months). He doesn't pay rent on time, enters people's rooms without permission when no one is around, doesn't pay bills on time, and isn't very considerate. We have a great deal on rent, and rent through a property manager. I'm afraid that he might want to stay for the awesome deal, but I want to renew the lease with new roommates. How can I effectively kick him out without complicating things and possibly suffer legal repercussions?

    Getting Rid of Roommate
Is this roommate on the lease?

yes, both of us are on the current lease. I've lived in the house a lot longer than he has, is there a way that has any bearing on anything?

    Renewing Lease
If the lease gives you the option of renewing, he may well share in that option to renew. If not, it probably doesn't make any difference.

You can negotiate with your landlord about renewing without your present roommate on the lease. However, if your tenancy continues and your roommate refuses to leave, that would probably put the onus on you to get him out. I doubt that the landlord would assume that responsibility on your behalf.
