Changing a Child's Surname in North Carolina
My question involves name change laws in the State of: North Carolina.
When my child was born, the father (we never married) was neither supportive nor present, and for lack of knowledge of the law or a desire, my child was given no last name.
Now the father is attempting to be a part of his child's life, and with his new found desire to be involved, he insists the child have his surname even though he is inconsistent with child support and I am the child's primary caretaker.
The child is coming of an age when things like school make having an official last name necessary. I understand that with regards to the changing of a minors name both parents must give consent.
I haven't the funds or the patience to fight this in court, or with him. I'm not looking for an easy way out and I'm sympathetic to the rights of the father.
I am looking to resolve the issue regarding a child with no apparent last name without necessarily caving into an inconsistent, and at this point unworthy father.
P.s. Hyphenation is for me not out of the question. I just would like to know more about what possible options I have.
Re: Changing a Childs Surname in North Carolina
Your child does have a last name.
It's probably yours.
Dad does have the right to petition the court for a name-change and at the very least - if you fight it - the child will likely end up with a hyphenated last name.
Given that this is a good chance of this happening, you might be better off simply offering Dad the compromise of hyphenation.
Then, it's simply a matter of filing a form or too with the court and having it recognized.

Your child has NO last name? So like their name is Madonna? or Cher?
What do you mean, the child has NO last name?
Re: Changing a Child's Surname in North Carolina
Is it possible that your child has no surname? I am also of the opinion that your child automatically gets your surname if you are not married and the father is not interested in the paternity.
Due to the fact that this post is half a year old I would be interested if your child now has a surname. Maybe you can briefly comment on this. Would really be interested in this case.

Mom can call the child Dingleberry Gates Schwarzenegger if she wishes.
And the thread is a month old.
A month today, actually. Happy Birthday, Thread!
