My question involves criminal law for the state of: oklahoma
i was 20 when i found out i was pregnant and the father (paternity not proven) was 15. i did not know how old he was until after i was pregnant. i am now 22 and he is 16, and his mother has just come into the picture. my daughter is 8 months old. my questions are what are my rights? could she take my daughter from me or press charges on me? im grateful for any advice my daughter is my life.
Mom cannot "press charges" but she can certainly report this to the police. In fact, anyone can. If the police get involved, they can and probably will forward the matter to a prosecutor who will then consider the filing of charges with the court.
The boy's mom could not take the child from you, but she might get custody indirectly if you are arrested and lose custody to the presumed father of the baby girl - her teenage son.
Re: Can My Daughter Be Taken
A couple of years ago, a woman demanded child support from the father of her son.
Only problem? The father was 15 when they had sex... and judges can do math.
She was awarded child support and a very nice prison cell for statutory rape.
