Should I Disclose My Arrest on My Medical License Application
I got arrested and give a deferred of entry. After I completed all the terms the charge was dismissed. On the minute order of the court it said "defendant's motion to withdraw guilty plea is granted and case dismissed for lack of prosecution." Now here is the question on the application for California medical license:
Have you ever been convicted of or plea guilty to any to any offense in any state of the U.S or foreign country?
Matters in which you were diverted, deferred, pardoned or if the conviction was later expunged MUST be included. If in doubt as in whether a conviction should be disclosed, it is better to disclose the conviction on the application.

Do I have to say yes to this question? It seems to me the question only ask for conviction which I was not convicted of anything.

You state you were deferred. The form specifically says deferred charges must also be disclosed. You should disclose it. Better to be upfront about it and be able to explain it then them find out you omitted it...and disqualified you.

I can see why you think that way but the charge was deferred then dismissed. Isn't it the same as the charge just got dismissed? I find it hard to imagine even if you were wrongly arrested and the charge got dismissed you still have to report and obtain police report for it. Also the fact they did not say "disclose all arrests or convictions."

If you were charged with assualt for example and then the da or judge dismiss the charge,it's different then going to court then getting the charge dismiss via a deferal or diversion program. I'm sorry but the question says to include any convictions even if it was deffered,it also states to lean towards the side of caution when to include something. It also seems like you did plead guitly at one point and then withdrew the plea. The backround check is probably very deep so the it probably gonna show the charge and the it was dimissed. It may come up as dismissed via diverison or something similar.

What screw you is the second part of the question.If it only was one simple question,have you ever been convicted of a crime,then you probably can answer yes.
