Boat Buyer Wants to Return Used Boat
My question involves a consumer law issue in the State of: NC
Last week I sold a small sailboat. They buyer and her friend inspected the boat and I informed them of all that I knew about the boat's condition. After taking the boat home she contacted me and said that she found what she considers a major defect and wants her money back.
Do I have any obligations to her?
Re: Boat Buyer Wants to Return Used Boat
What's the nature of the defect? Is it something the owner of a boat should reasonably have been expected to know about?
Did you execute a formal bill of sale, or otherwise get written acknowledgment of an "as is" sale? Did you otherwise agree to an "as is" sale?
Re: Boat Buyer Wants to Return Used Boat
The buyer says there is a section inside the fiberglas hull that has water in it. The boat is 32 years olds and I only used it infrequently. I did not have any knowledge of any problem of this nature. There was only a standard bill of sale transferring the boat for the payment of the agreed amount and the signing of the title over to the new owner. There was no expressed or implied warranty.
