    My Husband Was Caught Stealing $4000
    Hi, today my husband called to tell me that he was caught stealing from his job at CVS. they brought him in and asked him to admit to everything that he stole. which he did, the total came close to 4000 dollars, this includes money as well as pills. They told him that they arent going to press charges and they gave him a notice of civil demand.
    Even though they said that they wont press charges is there still a possibilty that they will? and will this be on his record to the point where it will effect him getting future jobs? can they still come and arrest him? what do we do from here? we live in New York.

    if the police are involved, yes. If the police are not involved, it would be on his personnel record at CVS. I would suspect CVS is not going to provide a glowing recommendation

    not much to do. Don't speak with anybody about this. Anything said can come back to haunt him if criminal charges are sought.

    Since some of the medications he took were controlled medications is the DEA going to be involved? Also should we be consulting a lawyer even though no charges have been made?

    As to the DEA being involved; if CVS is required to disclose this to the DEA, then yes, I would suggest you are only starting the journey.

    It wouldn't hurt to consult with an attorney. This could become a very serious criminal issue. Being prepared is never a bad thing.

    There could be valid reasons not to prosecute, but I would think that corporate would want to prosecute.

    It is possible they want to collect on the civil demand first. Paying the civil demand does not exclude later criminal charges. The charges are only limited by the statute of limitations.

    If some of the medications are controlled substances, that complicates things considerably.

    A criminal record is not the only thing that will affect future jobs. All major retailers participate in a shoplifting/retail theft database and once a person is in that database there will be no possible way to get a job with any participating retailer which certainly includes every pharmacy chain there is.

    I would consult with a good criminal attorney and arrange for representation for whatever happens. If you all don't want your husband to sit in jail for a lengthy period should he be arrested, now is the time to start saving some money for bail or selling unneeded assets.

    Also, make sure that you have full legal power over family finances.

    The answer is yes, when controlled substances (medications) are missing CVS is required to do an audit of their complete inventory and report their findings. I really think this will end up being reported to the police. Since the CVS store has a state pharmacy license, they are also required to report it to the New York State Pharmacy Board. My advice - hire an attorney who has expertise in these matters NOW.

    - He will be fired.
    - He will not be collecting Unemployment.

    if that is the case, then why would they have let him go without call the police while he was there, if this is going to become a criminal matter wouldn't they have had the DEA or police come while the loss prevention manager was questioning him.
    We are very worried because when he left all they told his is that he would have to pay restitution and his name would go on the ESTEEM data base, and that there would be no charges pressed, unless they found more/other stolen goods.

    This is really odd. The New York Civil Demand law only allows the retailer to collect a maximum of $500. I have no idea why they would limit themselves in this matter. I would have preferred charges and pushed for full court ordered restitution. I can tell you that CVS is known to file charges against employees who steal from them.

    Yes no question he was fired already but that's really all they did was fire him and have him sign a promissory note for the money to pay back... do you think they purposely lied to him to make him believe that nothing else was going to happen?

    Its not just $500 he signed a promissory note for the entire amount he admitted to..
