308 (B) Pc, What to Say to Officer
My question involves criminal law for the state of: California
I am 16 years old, and recently was cited for 647 (f) PC and 308 (b) PC for possession of a pipe. My understanding, from research, is that the 647 charge will most likely result in my license being suspended for one year, and that the 308 charge will result in a fine and/or community service. My question is: At my court date, if I am asked what I was using the pipe for, what should I say? I was not at all under the influence of marijuana, only alcohol, but the officers probably thought I had been using it for marijuana just before I was arrested. Because the citation is only for tobacco paraphernalia, should I say it was being used for tobacco, or say it was being used for marijuana, as it usually was? If I admit that it was being used for marijuana, can I have further charges pressed against me? I'd much rather tell the truth, but am not sure what will happen. Thanks for any help.

Your lawyer/public defender should make it so they don't even have to say what was in it. For all they know, you were holding it for someone else. I would just let your attorney do the talking to help eliminate your chances of getting in more trouble
