Apartment Management Requires 60 Day Move Out Notice at Exactly 60 Days
My question involves landlord-tenant law in the State of: Texas

My lease requires me to give a 60 day notice of move-out. My lease expires the end of September and I went to the office today to give my move out notice as its greater than 60 days before I would move out and they would not accept it. They had written by hand into the lease I must issue my move out notice on exactly the 1st of the month 60 days in advance. They said they could only accept my move out notice on August 1st and at no time before or after. I will be out of town that day which is also a Sunday and the manager said I could have someone drop it off on that day. I'm worried if I am not there they will say they did not receive it and keep me in my lease.

It seems crazy I could not submit an intent to move out more than 60 days in advance. Is there any legal advice for this? Is this allowed?

    Thanks

Most states now allow electronic mail for legal notification, so why don't you double check and see if you can send them an email on that day. I have to say giving notice on the exact 60th day is absolutely bizarre, and I beleive by making it so, they hope tenants would miss it, and they make another months rent out of people coming in one date too late, because they won't accept it one day too early.
