Unlawful Eviction in California
My question involves landlord-tenant law in the State of: CA.
how can i prove that our family was evicted unlawfully? we were forced out so to speak and locks were changed, only a 3 day notice was served to pay back rent and payments were maid towards it. a few weeks later my dad was at my apartment when my landlord started to change locks and police were called ordering my dad to leave.
later the night of the lock out (friday) i went to my apt to get whatever items i had in an outside storage when my ex landlord saw me and stated that trying to regain entrance in the apt was trespassing and he advised against trying to do so especially since im on probation. he then agreed to let me retrieve my property the next day(saturday). the following day came to no luck because he sent his sister to reschedule for the following day(sunday) at 3:00pm.
i returned to the apt arriving around 3:00 only to find our property outside of the apartment with everything ransacked, bags unzipped and searched, locked boxes broken into, with missing property admmitedly taken by the landlord. other tennants supported the witnessing of my ex landlord parting out our property on to truckloads to and from.
i notified authorities and they said it was a civil legal matter now and that since he was no longer at the property at the time of my complaint nothing could be done.
in conclusion lastly ive considered to counter-sue him for his claim to sue me for back rent, and apt reconditioning. he never gave the oppourtunity to repair or clean the apt since we were locked out. nor has he given me any news on my deposit. this happened on the first weekend of june wich our section 8 paid for to boot.we are homeless now.

You appear to be stating that you were given a three-day notice, that nobody went back the apartment for some number of weeks, and at that time the landlord was changing the locks? It sounds like you abandoned the apartment. What part did you leave out?

no we were there the whole time. never did we abandon the apartment. we just happen to be out on errands and returned home to fing out he was changing locks.
