Woman with Deportation Status in Appeal, Attempting Fraudulent Marriage
email conversation discusses 2 individuals being conned into marriage at same time!......one whom has backed out on her and the 2nd whom she is admittingly going to ask for the marriage. and whom she states has more time to prove to USCIS easier with. No mention of love in either case.
Is email evidence enuff to just hand into USCIS as proof?
How should it be "materialized" ...is email window left open not considered eavesdropping? I mean what is admissable? out of curiousity only. I dont know all details on it.
Also other emails show sadistic descriptions on how both are being easily manipulated by her. email is between her and other would be deportee as well...trading advice.
Outlandish. A shame it almost seems like until she is fully married and maybe gets caught for not bona fide....this "crime" will not be stopped before it is committed.
Any help for my contact is appreciated.

You are free to turn your information over to the USCIS, which presumably will investigate the report and take action that it feels is appropriate.

You've been given as much information as you're really going to get....nobody here can guess whether ICE will consider emails "enough" proof of wrongdoing.
(Not least since nothing wrong has happened yet...)

You can be sued by her for invasion of privacy. Even if it was left in the open. What is your relationship to her anyway? Especially when mentioned the 'other' emails. There was tresspasing involved since you clearly opened an email that is not yours. Kinda like the rules on snail mails.

It's not "invasion of privacy" to turn information over to the USCIS. It's not "trespassing" to look at an open email somebody else left displayed on a computer screen. This is a legal board, not a "I just made something up" board - if you don't know what you're talking about it's best not to post.

Did you read what I say about the "other" emails he opened. Granted it was left open. The only way he can read the other emails is if he clicked on it which is not his email, not his PC, none of his business, and he was not supposed to see. Your username is the type of people I won't bother to argue with. It is self explanatory. But he also has a right to send to immigration what he thinks is foul. I am just telling him what might be counter sued to him. Unless he tip the immigration anonymously.

This would never in a million years reach the standard of invasion of privacy.

unwarranted appropriation or exploitation of an individual's personality, publication of an individual's private affairs which would cause embarrassment,wrongful intrusion upon an individual's private concerns/activities
Those 3 types fall into this case. So. Yes!

You leave your email program open, and leave the room KNOWING there are other people present who may be able to access your email.
There is NO reasonable expectation of privacy in that scenario.
Understand?
And don't EVEN come back and try to compare it (like you did earlier) with snail mail.
That's a completely different set of circumstances governed by a completely different set of laws.

It was my contacts own computer as well.
Also would he have to explain how he came way of seeing them?....Im not sure if he printed them....but it seems like he has...is that another issue?
When I say would he have to explain how he came way of them...I mean to USCIS when turning the information in....or can he just tell them if they ever decide to ask?
What do you think the outcome might be like in this situation....would it be deemed fraud....it sure as hell looks like it to me...but we don't know their rules or laws.
Also thank you all....lets share info and get along....maybe some are right and others are wrong....but thanks for your input I appreciate.

Well, the problem with email is that in order to prove something, one must show WHO exactly sent the email.
Getting the IP information is one thing but if there is even ONE more person who has access to the same computer it may be impossible to prove who wrote what.
Again, all that can be done is that the information is reported.
What happens after that is out of your hands.

Don't know what u mean the email clearly shows from who and to who...as part of it's header. Ip addresses would only be a more exact measurement.

Prove that it wasn't His or Her friend who lives there.
Prove that it wasn't Her boyfriend's Uncle Teddy.
See where I'm going here?
ANYONE who has access to the computer and email account could have written it.

if they did doubt it they could investigate closer via ipz and what not ....
What are u saying that right from jump a printed email is not considered?

Because it's not uncommon (for example) for an embittered ex to fabricate evidence in order to get the other party into legal trouble.
That's just one example.
This is why emails are often very difficult to get introduced as evidence in court.
Do you realize how many bogus calls are made to ICE?
I'm a legal immigrant; I've been here a LONG time. Yet my ex-husband frequently called ICE after we divorced, trying to get me into trouble and/or deported.
(He failed miserably and eventually gave up).

Well the email on the other end is from a place of business I am certain it can be subpoena'd and IP addresses can be traced. I dont see why a court would jump to the conclusion that u speak of.
Sounds more like you might be embittered...by your situation.
Im looking for unbiased information not someone who doesnt agree with so called "tattling"
Im certain some marriages go into good faith and fail.
But by the same token some marriages are pre-meditated scams....and they should have their green cards pulled or never given to them...if it can be proven.
Which is the base of this thread.

YOU have not realized that more than a few ppl have told you ...YOU are not aware of the facts.
Perhaps your problem lies in questioning yourself as to WHY he wanted to do that to you?
even if by way of imbitterment.....either way trolling this site is not the answer!
Why not blog what plagues you psychologically or see a therapist for whatever weighs your concious....Im certain your guilts will one day be alleviated.
