Misdemeanor Misuse of a Firearm
My question involves criminal law for the state of: Michigan
Nearly 2 months ago I was apparently charged with misdemeanor misuse of a firearm (I'm a FLEO) by local police (received no papers/citation etc). They questioned me then confiscated my service weapon and I've been placed on limited duty awaiting my court notice. It's been a long time and I'm wondering if they're going to send me anything at all. Is there a statute of limitations on being formally charged? Or are they just playing a jurisdiction game? Not having my service weapon has placed serious limitations on my job effectiveness and I'm wondering if there's anything I should be doing to resolve this?

Have you checked with the court to see if a charge is yet pending? If the prosecutor has not yet authorized charges, there may be a reason - consider hiring a criminal defense lawyer to try to intercede with the prosecutor and to try to convince the prosecutor not to authorize charges (assuming they are still planning to do so or have not yet made up their minds.)
The general statute of limitations for crimes in Michigan is six years.
