Is It Possible to Remove the Fathers Name Off the Birth Certificate of a Child
My question involves name change laws in the State of: Arizona
Is it possible to remove a Fathers name off the birth cerificate? I'm originally from Mexico and I'm thinking of moving back. I tried to get my Son his passport but they told me I couldn't process it without his Fathers consent, so I figured that in the future I'm going to keep running into this type of issues when it comes down to legal matters because he is on the birth certificate. So my question is if its possible to take him off the birth certificate so that I won't have to ask for his approval when I need to do something with him. He was never taken care of him or ever really been around. He never took care of my expenses while I was pregnat either. Hes been in prison for almost 2 years and will be for 1 more year so its hard to even get in contact with him. If you can help me out with some advice I would really aprecciate it, Thank you for your time.

Do you have any court orders defining custody?
You cannot get him removed from the birth certificate unless paternity is legally disestablished in court. Depending upon the nature of the crime, you MAY be able to get his parental rights terminated in court and you'd need an attorney for this.
Other than that, the State Department requires that either you get Dad's consent or that you have sole legal custody in order to get a passport.
