    My question involves divorce in the State of: Florida

    I have divorce papers that were drawn up in 2007 by an attorney here in Florida. The attorney was not able to locate the husband and I could not afford (after a year) to keep her on retainer after so many failed attempts to locate him. I received notice from the court recently that the case had been dropped due to inactivity.

    I have just learned that the husband is in jail in SC awaiting trial and will most likely go from there to prison for 5-10 years.

    Is there any way I can use the petition that was written up by my attorney to get this finalized? We "last resided together as husband and wife in FL on or about March 10, 2002", there is a child between us (10 years old), no child support has ever been paid by him - according to the state of FL, they couldn't locate him either. Now that I know where he is I would like to know how to take care of this as quickly and inexpensively as possible.

    I would see the lawyer, or another one, to make sure the papers are still valid and served to him.

    If the case has been dismissed, you'll need to refile a new petition.
