    Modify Support While Working Under the Table
    My question involves child support in the State of: Washington

    I live in Washington and wish to attempt to modify my support. It’s been nearly 8 years since the last mod. I’ve been rather afraid of asking for a modification due to the possibility of my obligation going up.
    8 years ago my obligation came out as $467 a month, off of a $9.80/hr job.
    I pay my support on time and have never been late or fallen behind as it was set up via DSC as a garnishment.
    I’m now finding it really hard to make ends meet and think it’s worth a try. My question is: I’m working a new job where I’m paid under the table. I don’t want to do something if it’s going to potentially cause problems for my employer, or risk me loosing this amazing job.

    Has anyone been up front with DSC and said they are paid under the table?
    It’s no secret to my ex where I work, but I would like to avoid telling DSC only to protect the business and my job.

    Any advice is appreciated.

    There's EVERY chance your support obligation will go up.

    What is DCS actually garnishing if you're working under the table?

    I've been sending in checks. Seems like as long as the checks arrive, they don't ask where the money comes from. Right now I'm hoping my obligation could go down. My ex is making a lot more than she was 8 years ago, and my $467 is just about 45% of my net.

    Go here for the WA cs calculator.

    Plug in the numbers, and see what it spits out.

    You must bear in mind that WA will likely impute you an income of at least minimum wage regardless of your under-the-table earnings.

    Thanks for the link. I've used that a few times.

    Do you know the order in which I go through this?
    I have the form to request the mothers income information ready to send off. I could'nt even guess what she makes. She has 3 iorns in the fire.

    The rest of these forms are of little uses without her numbers so I assume this is my 1st step, correct?

    Can I send in my financial information on theOrder Review Request and leave her infomation blank? What about the parts where incomes need to be added, or % factored?

    You said you were earning X amount.

    You now say you're earning Y amount, presumably less, correct?

    Can you prove this?

    How do you know your ex is making more?

    I was making 9.80/hr working full time + when the order went in place 8 years ago.
    She was working 15 hours a week at ~$7/hr plus tips.

    I now make 12/hr under the table, working 23 hours a week. She is a realtor and property manager for vacation rentals. Two separate incomes.

    Some of it is assumption; based frequent vacations, a $50K SUV. She is married, and he does well. I understand that is not factored for support. But she seems to being doing well herself. She is very busy "working"

    Edit: I can prove my income. I am paid with a check and my bank statments will show my income and debts. My deposits are every two weeks lick clockwork so I'm not cashing them somewhere else.

    Then it's entirely possible that if you take this to court, you will end up paying more than you are currently.

    Your income has increased, and hers - from what you've said - hasn't.

    My income has decreased;
    9.80x40= 392
    12x23= 276
    Do you know if there is harm in submitting a request for her financial status.

    You're missing the point ;)


    WA will likely impute you a full time wage - 40 hours - at your current hourly salary unless there is some reason you are physically unable to work full time.
