Marijuana Paraphenalia First Offense, in New Mexico
My question involves criminal law for the state of: New Mexico
I was stopped because my lights were off.. long story. The officer smelled pot, asked me to step out of the vehicle and asked me if there was anything illegal in the car. I straight up gave him a pill bottle with less than .03 grams of marijuana that was in my pocket and i gave him a pipe with residue. he gave me a citation for the pipe but not the pot because there wasn't enough. i want to know what i could be facing once i get to court, also will this stay on my record and affect my scholarship? I have a state given scholarship to the University of New Mexico. This is a first offense and wish to find out what I should tell the judge. Should I plead guilty?
    any help is appreciated.
    thanks

Possession of paraphernalia is punishable by up to one year in jail and a fine of $50 - $100 (plus additional court assessments). As a first offender you may be eligible for a deferral, so I do not suggest pleading guilty before you determine if you can avoid a conviction. If you plead guilty, you will be convicted and sentenced, most likely to probation and to payment of fines and costs.
