    Caught Shoplifting at JCPenney in Michigan
    My question involves criminal law for the state of: Michigan
    In October 2007, I was caught stealing items from JcPenney. I stole earrings and a jacket, the total cost of the merchandise was less than $50. The officer came after me as I was walking out the door and she handcuffed me, it was kind of rough, but I deserved it. It was my first offense and I had no criminal record. I was 13 at the time. The officer took my stuff and gave it to the other officer there. I was led into a office and was told to sit down. My mom was with me and she had no idea that I had stolen. So she was a bit terrified and confused. The officer (female) called my mother the b word and that she was not a fit parent and other rude things that broke my moms heart. The female officer was really mean and it wasn't my moms fault. My mom just stood there taking it while the officer spitted her every word at her. I felt so guilty because my mom is my hero and she truly is an amazing woman that has been through a lot. Anyways, the lady brought out a camera and took a picture of me first then my mom, even though she wasn't involved. They brought out two forms to sign and fill in our info. All I did was cry, the cops were not called, but she warned us they JcPenney may file charges against me. The other officer (male) asked us if we wanted water or anything. He was really friendly to my mom especially after what the female officer told her. The female officer told us we were not allowed to come back. Oh I forgot, the jcp is at lakeside mall. The male officer walkeds us to our car and we were told to leave the premises immediately. If we came back, the cops would be called and we would be arrested. A few weeks later, there was a civil demand for $200 each for me and my mom. My mom paid it instead of fighting it in court since she didn't steal. My mom got a lawyer so it couldn't end up being nasty. A few weeks after I was summoned to juvi court and the judge said since all my grades were A- and higher and that I wanted to become a neurosurgeon, he would give a class that I had to take and complete. I went to the classes (2) and I took the final test which I got a 100% on for the class. So there was no further action for me, but my mom got a warrant for her arrest and she wento to the jail but wasn't put in a cell. Her lawyer got the judge to dismiss the charges. So I don't have anything on my record but I don't know about my mom. Anyways my question is that I won a makeover and its at the same mall as jcp. But its at a restuarnt at lakeside mall. Its been almost 4 years, can I go to lakeside mall without getting arrested? Btw I'm 16 now and have learned my mistake and haven't done it since then. Thanks in advance

    You would have to ask your mom how long the Trespass Notice was for. If she doesn't know, she needs to call the store and ask.

    Until you know you are not banned, DO NOT step foot onto the property, if you or mom are recognized, you can be arrested.
