Is Profanity an Exception to Free Speech
I know that obscenity is an exception to free speech, but that's only one category of profanity.
Would other categories of profanity be constitutionally protected?
I know that a few curse words here and there would probably be protected; I'm talking about emailing a school superintended and f*cking demand that that c*ckcsucking piece of sh*t remove your kid's f*cking suspension on the double, because the suspension is bullsh*t discrimination, and they if the maggot doesn't remove the suspension right the f*ck now, the school is getting sued out its *ss
and then the school's security guard calls and says "You are hereby banned from school's campus for a period of one year, and if you directly contact any of us during that time, you will be arrested on the spot. You just can't say stuff like that."
Would that give the parent a cause of action?
Re: Is Profanity an Exception to Free Speech
Yes.
The parent should extract his/her head from his/her butt and learn how to behave like an adult.
That's the parent's cause of action.
There is no cause of action against the school.

And, how so?
Specifically, what exception to First Amendment rights would they use, here?
Re: Is Profanity an Exception to Free Speech
Exercising your 'right' to free speech does not mean there are no repercussions for what you said.
Example - If you yell fire in a crowded theater and create a panic you are exercising your free speech. When you are then banned from said theatre that is the repercussion.
If you CHOOSE to talk to people with such animosity, they in turn can insulate themselves from dealing with you.
Out of curiosity - what did your kid do to earn the suspension?

How is this any way like yelling fire in a theater?
Honestly, the "yelling fire in a theater" thing is in place because yelling fire in a crowded theater tends to incite an immediate breach of the peace, which the government has a compelling interest in preventing.

Not if they're the government.

He's autistic, and he said something that the teacher perceived as a threat, but disability laws explicitly state that a direct threat must be a significant risk of health or safety that cannot be eliminated by reasonable accommodation. They didn't even TRY to accommodate it, and that's why I'm so angry.

Oh good Lord! WHY do I not read a person's previous posts before I attempt to enlighten them? :wallbang:
Stebbinsd - please don't bother answering my question about the suspension. The point is moot.

Look, you can either reply with an ACTUAL ANSWER, or you can move on.
But, those last two posts are nothing but spam.
Either answer the question, or don't.
Re: Is Profanity an Exception to Free Speech
For those of us familiar with you and your games, stebbins, that would be a DON'T.
Why don't you go play them somewhere else, preferably a board where none of us post? We're getting quite bored with you.

What games?
If my posts really were so stupid, wouldn't you be able to actually refute them in a manner such as this?

What are you playing at? What "games" are you talking about?
